The Court of Appeals for the Third Circuit rejected a motion by supporters of American President Donald Trump who demanded that Pennsylvania not count ballots received by mail after polling day. This was evidenced by a ruling that was received on Friday in the court’s electronic database.
The lawsuit was filed by a group of voters, including Republican Jim Bognet, who was seeking to be nominated by a state congressman. They demanded that approximately 9,300 ballots, which were mailed after 3 November, not be counted in Pennsylvania. Earlier, the court of first instance refused to satisfy these demands.
According to the ruling, the Court of Appeals upheld this decision. As Brooks Smith, Judge of the Court of Appeal, emphasised, “the votes legally cast by all citizens must be taken into account”. The document specifies that the Court of Appeal “confirms the District Court’s refusal” to satisfy the plaintiffs’ demands.
