European Commission is ready to continue the transfer of data from EU residents to the US, despite the court’s decision

Earlier, the European Court of Justice annulled the agreement between the EU and the United States of 2016 on the transfer of electronic personal data due to their insufficient protection from interception by American special services.

The European Commission (EC) announced that EU countries will be able to continue to transfer personal data of their citizens to the United States, despite a European court ruling that annulled a bilateral agreement on the transfer of personal information on Thursday due to possible abuse by American intelligence services. This was announced at a briefing in Brussels by the deputy head of the EC Vera Yurova.

“The EU court ruled to annul the data transfer agreement, but it confirmed the EU data protection directive, under which the exchange of information between the EU and the US will continue for now”, – she said.

On Thursday, the European Court of Justice annulled the agreement between the EU and the US from 2016 on the transfer of electronic personal data due to their insufficient protection from interception by American special services.

“This agreement creates conditions for the violation of the fundamental rights of European citizens during their transfer to the American side”, – the published decision of the instance notes. It emphasizes that in the United States, government agencies’ access to such information is limited to a much lesser extent than in the EU countries.

“From the court’s point of view, serious restrictions on the protection of personal data in the United States arise in connection with the American law on the access of US government agencies to personal electronic data, including those received from the countries of the European Union”, – the decree says.
