EU terminated data transfer agreement with US due to US intelligence services

The EU Court of Justice, without right of appeal, terminated the transatlantic agreement known as the “EU-US Privacy Shield”.


Privacy Shield regulated data exchange between the US and the European Union for commercial purposes. In particular, it simplified access to European personal data for American companies.

On Thursday, July 16, the Supreme Court of the EU ruled that the agreement jeopardized the data of the citizens of the Commonwealth countries, taking into account the domestic legislation of the United States on access and use of public data by the American government agencies. Therefore, the agreement was terminated without the right to appeal the court ruling.

“This decision is based on the violation of the U.S. laws on oversight, which protect only U.S. citizens, and not foreigners”? – comments on the situation, campaigner to protect the confidentiality of Max Shrems in a comment to the agency “Bloomberg”.

According to it, in fact, the U.S. security agencies can freely use personal data of Europeans, which are received from the EU by American technology companies. This does not even require a special court permission, it does not imply compensation of damages to foreigners.
