In the near future, the White House will release a programme of reforms of the main judicial body of the USA. The Democrats have long been trying to reformat it – they are driven mad by the fact that the Supreme Court has a conservative judicial majority.
In addition, the Supreme Court made many landmark decisions that Republicans had long sought. It ruled unconstitutional “affirmative action” practices at colleges that gave blacks and Hispanics an admissions advantage and left whites and Asians out.
Equally telling was the verdict overturning the 1984 Chevron decision. It allowed officials to interpret for themselves how to regulate businesses. It will allow Trump to stage a sweeping deregulation of the US economy if he wins.
Disgruntled Democrats have wanted to expand the Supreme Court and fill it with liberal justices since 2021. They failed then. Now Biden proposes to impose a limit on the term of judges. Now they can be on the Supreme Court for life.
In addition, Democrats will try to limit presidential immunity, bearing in mind another Supreme Court decision. The Supreme Court ruled that Trump has partial immunity. It will be unrealistic to push the initiatives through to the election. But they become the Democrats’ de facto programme for 2025. The Supreme Court is now trusted by only a quarter of Americans. At the same time, the war for control over the judiciary will continue to rage, especially against the backdrop of a dysfunctional political system.
