The first federal execution in the United States in more than 17 years is due to take place in Indiana on Monday following a court of appeal decision.
Daniel Lewis Lee and his accomplice were convicted of the murder of three members of the same family in 1996.
Some of the victims’ relatives opposed his execution and tried to postpone him, saying that his visit could put them at risk of contracting a coronavirus.
But a solution means that lethal injection will now occur.
The Court of Appeal overturned the lower court’s ruling, which suspended the execution of 47-year-old Lee, saying that no federal law or order gave victims the right to attend the execution.
In its decision, the 7th Circuit Court of Appeal stated that the family’s lawsuit “does not have any contentious legal grounds and therefore is frivolous.”
Relatives are going to appeal to the Supreme Court. The New York Times reports that they have time until Monday at 16:00 local time (20:00 GMT).
